Statute, not another raid |
Taiwan's next product is the Foreign Trade Act or the controlled list. |
| |
| |
⚡ THE SETUP |
Taipei Times, September 4 (Kung remarks September 3). Suspected May transshipment to China of servers equipped with advanced chips, involving three Taiwanese defendants, is an export-control issue.
Same Kung day. Government is considering amendments to the Foreign Trade Act or adding specific products to controlled lists, with relevant agencies coordinating. CNA via PChome: whether to amend the Act or put items on the control list can still be designed. National-security cross-ministry coordination. MOEA will follow national-security tempo. A final bill has not passed.
Same Kung day, contrast only. Unimicron alleged origin laundering is a different problem from high-end chip diversion. Substantial transformation / ≥35% value-add before an origin relabel. Taiwan standards versus US CBP final call.
Trump's Stock Warning When a powerful US ally moved against one American company, Trump warned them they were making a big mistake. Karim Rahemtulla on why that company matters. Paid advertisement on behalf of Monument Traders Alliance, 14 West Mount Vernon Place, Baltimore, MD 21201. Past performance is not indicative of future results. After the indictment week, Taiwan's next product is not another raid. |
It is the Foreign Trade Act, or the controlled list. |
The control surface is moving from prosecutors to statute. |
That is the load-bearing line from Minister of Economic Affairs Kung Ming-hsin, speaking on September 3 and reported in the Taipei Times on September 4. |
The suspected May transshipment to China of servers equipped with advanced chips, involving three Taiwanese defendants, is an export-control issue. |
The government is considering amendments to the Foreign Trade Act or adding specific products to controlled lists, with relevant agencies coordinating. |
CNA, carried on PChome on September 3, has Kung saying whether to amend the Foreign Trade Act or put items directly onto the control list can still be designed. National-security units are running cross-ministry coordination. MOEA is prepared and will follow national-security tempo. |
Legislative draft pressure already exists to close Strategic High-Tech Commodities loopholes and put unauthorized AI-chip diversion into criminal scope. A final bill has not passed. |
The product is the statute path versus the controlled-list path. Kung Ming-hsin named both. National-security cross-ministry coordination, including MOEA and the Ministry of Finance on the customs side, is the process. |
Once diversion is a weekly story, the scarce layer is whether the statute or the list catches whole classes of AI chips and servers. That is independent of any single case. |
UDN's September 3 corroboration sits in the same Kung day. Same coordination language. |
The same Kung day also carries a contrast that is not the thesis. Unimicron alleged origin laundering is a different problem from high-end chip diversion. Substantial transformation. A thirty-five percent value-add before an origin relabel. Taiwan standards versus a US CBP final call. |
Prosecutors can charge a shipment. A statute or a controlled-list rewrite can catch a class. |
That is the mechanism that does not decay by evening. |
The May server case put diversion on the table. Kung put the Foreign Trade Act and the controlled list next to it. |
Between those two paths, the scarce layer is which surface actually catches the next class of chips and servers before another indictment cycle. |
A raid closes a case. A list change closes a loophole. |
That is the tap I want on Friday's close. |
Cross-ministry coordination is still process. The product is still the statute or the list. |
MOEA following national-security tempo is still process. The product is still which gate the legislature and the ministries write down. |
Until that gate is written, diversion stays a prosecutor story. After it is written, diversion becomes a classification story. |
That is the move from paper in a case file to paper in the Foreign Trade Act or the Strategic High-Tech Commodities list. |
I will watch which path they pick. I will not pretend a draft has already become law. |
Statute or list. Class, not case. That is Friday's close. |
The indictment week put diversion on the calendar. Kung put the Foreign Trade Act and the controlled list on the same calendar. I am watching which paper they write first. |

|
Prosecutors close cases. Legislatures and ministries close classes. |
Until the Act or the list is written, diversion stays episodic. |
After it is written, the next diversion is a classification problem first. |
Taipei Times put Kung's two paths next to the May diversion case. |
CNA put the design choice next to national-security tempo. |
UDN put the same coordination language on the same day. |
The scarce layer is which paper Taiwan writes first. |
Class first. Case second. That is the close. |
This evening the scarce piece is the statute surface. |
| |
| |
A raid closes a case. A list change closes a loophole. |
|
|
|
|
The Foreign Trade Act or the controlled list is the tap. |
| |
| |
🔎 THE SECOND DERIVATIVE |
Somebody else has to write the class into statute or onto the list. The Act and the controlled list sit under the diversion story. The paper, not another indictment. That is the tap I want. |

The foil is treating another indictment as the product, or sitting with Unimicron origin-laundering as if it were the export-control spine. The product is still the statute or the list. |
